A McHenry man has been sentenced to nine years in prison after he pleaded guilty to sexually assaulting a child under the age of 13, who he was supposed to be caring for.

Joseph Calbillo, 24, of the 3700 block of West Ellen Road in McHenry, was charged with two counts of predatory criminal sexual assault of a victim under 13, a Class X felony.

On Friday, McHenry County Judge Robert Wilbrandt approved a plea deal between Calbillo and the McHenry County State’s Attorney’s Office.

Calbillo pleaded guilty to one count of predatory criminal sexual assault of a victim under 13, a Class X felony, in exchange for his second count being dismissed.

Wilbrandt sentenced Calbillo to nine years in the Illinois Department of Corrections, court records show.

The McHenry County Sheriff’s Office said they began investigating Calbillo in September 2020 after a concerned parent made a report with sheriff’s deputies.

An investigation was initiated by the McHenry County Sheriffโ€™s Office Criminal Investigation Division which revealed that Calbillo had sexually assaulted a juvenile in his care, the sheriff’s office said.

An arrest warrant was issued for the man and he was later arrested by the McHenry Police Department.

Further details regarding the assault were not released.

Calbillo will be required to register under the Sex Offender Registration Act for life upon his release from prison.

The case was investigated by Detective Mike Quick of the McHenry County Sheriffโ€™s Office and prosecuted by Sharyl Eisenstein of the McHenry County Stateโ€™s Attorneyโ€™s Office.
