A toddler was dropped to the ground and a woman accidentally fell on the child during a struggle with a Waukegan man in Zion, prosecutors said.
Jose Castaneda-Martinez, 35, of Waukegan, was charged with two counts of domestic battery physical contact and two counts of domestic battery bodily harm.
Lake County Assistant State’s Attorney Caitlin Valiulis said during a bond hearing Tuesday that there are two victims in the case, a 3-year-old girl and the mother of the child.
Castaneda-Martinez, who is the child’s father, was watching the toddler earlier in the day.
The mother asked Castaneda-Martinez to drop their child off to her.
The woman found out Castaneda-Martinez was highly intoxicated and became upset with him, Valiulis said.
The woman, who pays for Castaneda-Martinez’s phone bill, took his phone from him.
The two began wrestling over the phone. The woman was holding the toddler at the time and she ended up dropping the child at the bottom of the stairs, Valiulis said.
The mother picked up her child and put her back in her arms when Castaneda-Martinez allegedly pushed the woman to the ground while she was holding the baby.
She fell onto the ground on her stomach and landed on the baby, Valiulis said.
Castaneda-Martinez left but came back later and allegedly threw rocks at the window of the residence.
Officers with the Zion Police Department were called to the scene and they observed minor injuries on both the child and the mother.
Lake County Judge Theodore Potkonjak ordered Castaneda-Martinez held on a $50,000 bond.
He remains in the Lake County Jail and would need to post $5,000 to be released.
An arraignment hearing is scheduled for Friday.
