A Waukegan man has been charged with street racing and driving 100 mph just before he crashed head-on into another car, killing a 78-year-old man in Beach Park in October.

Tabios J. Day, 32, of Waukegan, was charged with reckless homicide, aggravated street racing and aggravated reckless driving causing great bodily harm.

The incident happened around 1:15 p.m. on October 10 at Sheridan Road and West Howard Street in Beach Park.

Sheriffโ€™s deputies arrived and found a two-vehicle crash with heavy damage, according to Lake County Sheriff’s Office Deputy Chief Christopher Covelli.

An investigation showed a Toyota Prius, driven by Peter Kliora, 78, of Waukegan, was making a left turn from Howard Street onto northbound Sheridan Road.

An Infiniti M35, driven by Day, was traveling southbound on Sheridan Road in the same area.

Both vehicles collided in the intersection, resulting in heavy damage to the vehicles.

Witnesses reported the Infiniti was traveling at a high rate of speed and recklessly prior to the crash, Covelli said.

Crash investigators determined Day was traveling nearly 100 mph and drag racing another vehicle just prior to the crash.

Kliora was trapped in his Toyota and had to be extricated from the vehicle.

Kliora was transported by ambulance to Vista Medical Center East in Waukegan where he was pronounced dead.

Day was transported to Vista Medical Center East with serious but non-life-threatening injuries.

A grand jury returned an indictment charging Day last week. A judge signed an arrest warrant carrying a $350,000 bond.

Day appeared in bond court Tuesday morning in a wheelchair.

Lake County Assistant State’s Attorney Manuel Mandujano said toxicology results showed Day had Delta-9 THC and fentanyl in his blood at the time of the crash.

Day told investigators he smoked marijuana the day before the crash and took a Norco pill from a friend, Mandujano said.

Day also told investigators that he had been trying to catch up to another vehicle that had cut him off when he collided with the victim’s vehicle, Mandujano said.

Lake County Judge Theodore Potkonjak ordered Day held on a $350,000 bond, which was set when the warrant was issued.
