Police arrested a man who allegedly stabbed another man in the neck with a kitchen knife during an argument outside of a gas station in Waukegan.

The Waukegan Police Department and Waukegan Fire Department responded around 9:20 p.m. Tuesday to Thorntons gas station, 3233 Grand Avenue in Waukegan, for a report of a person stabbed.

Officers found a male victim who had been stabbed in the neck.

Paramedics transported him to Advocate Condell Medical Center in Libertyville with non-life-threatening injuries.

Lake County Assistant State’s Attorney Dino Katris said the victim is an acquaintance of Daren Thut, 26, of Park City.

The two, who are homeless, were at the gas station when an argument ensued.

Thut claimed the victim attacked him but surveillance video contradicted the statement, Katris said.

Katris said the video showed the two arguing when the victim raised his hands and began backing away from Thut.

Thut could be seen with something in hand when he swung at the victim’s neck, resulting in a puncture wound.

Officers arrested Thut and he was charged with aggravated battery with a deadly weapon, a Class 3 felony.

The weapon involved was not recovered but Thut admitted he was in possession of a kitchen knife, Katris said.

Katris said Thut is a danger to the victim and a danger to the community in arguing for him to be held pre-trial. “It shows that the defendant can’t use his words to have a disagreement.”

A public defender for Thut said the alleged victim was the “clear aggressor” and put his hands on Thut’s throat during the altercation.

Lake County Judge Theodore Potkonjak granted prosecutors’ petition to detain Thut in the Lake County Jail.

The judge said he found that Thut is a real and present threat to the community.

Thut remains held in the jail and is scheduled to appear in court again on October 24 for a preliminary hearing.
