A grand jury has charged the driver of an SUV with driving under the influence and causing a crash that killed a motorcyclist in Round Lake Beach earlier this year.
Derek J. Drake, 31, of Lake Villa, was charged with aggravated driving under the influence causing a fatal crash and reckless homicide.
A grand jury returned an indictment charging Drake last Wednesday, court records show.
An arrest warrant was issued and the Round Lake Beach Police Department arrested Drake Tuesday afternoon.
The charges stem from a two-vehicle crash with injuries that occurred around 7:57 a.m. on May 21 at Route 83 and Engle Drive in Round Lake Beach.
Officers arrived to find a crash involving a 2001 Jeep and a motorcycle, according to Round Lake Beach Deputy Police Chief Ryan Rodriguez.
The Jeep, driven by Drake, was traveling southbound on Route 83.
The motorcycle, driven by David Paul, 56, of Skokie, was traveling northbound on Route 83, Rodriguez said.
The Jeep attempted to turn left onto eastbound Engle Drive and collided with the motorcycle.
The investigation showed Paul had the right of way and Drake failed to yield while turning left.
Paramedics pronounced Paul deceased on the scene, Rodriguez said. The driver of the Jeep was uninjured.
The Lake County Major Crash Assistance Team (MCAT) was called to the scene to assist with the investigation.
Route 83 was shut down between Monaville Road to Engle Drive for several hours.
Rodriguez told Lake and McHenry County Scanner that toxicology results showed Drake was under the influence of THC.
Drake will be transported to the Lake County Jail for First Appearance Court. It is unknown yet whether prosecutors will seek his detainment pending trial.
