A judge called a 36-year-old man a danger to the community after prosecutors said he was selling drugs and police found him with a large amount of fentanyl in McHenry County.

Dontay Marshall, 36, of Carpentersville, was charged with manufacturing or delivery of 100-400 grams of fentanyl, manufacturing or delivery of a controlled substance, two counts of possession of a controlled substance and one count of attempted possession of a controlled substance.

A criminal complaint filed in McHenry County Circuit Court alleges Marshall was found with over 300 grams of a substance containing fentanyl.

The substance was pressed into pill formation and packaged into four separate bags, the complaint said.

Marshall also possessed a half-gram of cocaine and 40 pills of suspected Oxycontin, the complaint added.

Marshall was arrested by the McHenry County Sheriff’s Office around 1:15 p.m. on June 14.

The McHenry County State’s Attorney’s Office filed a petition to detain Marshall pending trial, calling him a real and present threat to the community.

He was transported to the McHenry County Jail and appeared via Zoom from the jail for a first appearance hearing the following day.

The hearing was continued to last Monday in front of McHenry County Judge Carl Metz after Marshall reported that he was sick and did not have time to speak with an attorney.

During the subsequent hearing, Metz granted the prosecutors’ petition and said he found the proof was evident and presumption great that Marshall committed the offense.

The judge also noted that the man was found in possession of the drugs during his arrest and information from Marshall’s phone that indicated he was selling drugs.

Metz called Marshall a real and present threat to the safety of the community and mentioned the “sheer number of fentanyl dose[s].”

The judge said there were no conditions of release to mitigate Marshall’s potential for further criminal activity.

A preliminary hearing is scheduled for July 12.
