A man was released from custody after authorities say he threatened to kill a sheriff’s deputy and then put the deputy in a chokehold while resisting arrest at a gas station near Lake Zurich.
Dayon L. Sanders, 36, of Lakemoor, was charged with aggravated assault to a peace officer and resisting arrest.
The Lake County Sheriff’s Office responded on August 3 to the Shell gas station at Route 12 and Miller Road in unincorporated Lake Zurich for a call of an intoxicated person.
A sheriff’s deputy found the person, identified as Sanders, on the ground near the gas pumps, according to Lake County Assistant State’s Attorney Emma Smoler.
Sanders, who was exhibiting signs of intoxication, began to wake up when paramedics arrived.
Sanders told deputies he had consumed 15 shooters and then became agitated, Smoler said.
Deputies tried to calm Sanders down but the man told a deputy he was going to kill him, Smoler said.
Smoler said Sanders took off his shirt and began beating his chest while saying “come on” and getting into a fighting stance.
Sanders got closer to the deputy and the deputy took the man to the ground to arrest him.
While the two were on the ground, Sanders put the deputy into a chokehold, Smoler said. The deputy suffered scrapes on his hand and knee.
The charges are non-detainable under the Illinois SAFE-T Act.
Lake County Judge Donna-Jo Vorderstrasse released Sanders following a First Appearance Court hearing where she placed the man on Level 4 pre-trial services and ordered him to not consume alcohol or drugs.
She also ordered him to have no violent or harassing contact with the police.
A status of preliminary hearing is scheduled for Tuesday.
