A man allegedly forced entry during a residential burglary in Woodstock and damaged items in a home after threatening the woman who lives at the residence, court records show.
Adrian Fernandez, 40, of Wonder Lake, was charged with residential burglary, criminal damage to property, violation of an order of protection and criminal trespass to residence.
A criminal complaint filed in McHenry County Circuit Court alleges Fernandez entered a residence in the 1500 block of Walnut Drive in Woodstock with the intent to commit a felony around 6 p.m. last Friday.
The complaint said Fernandez kicked the front door of a woman’s residence until he was able to make entry.
The door frame, latch, inner workings of the door, strike plate, trim surrounding the door and drywall to the interior of the residence were damaged.
Fernandez then destroyed a Christmas tree in the home’s living room and various items that were being hung, the complaint said.
The complaint said Fernandez left the residence and drove over the front yard, causing ruts to be cut into the grass from his car’s tires.
At the time of the incident, Fernandez was the respondent in an active order of protection sought by the woman whose house was burglarized.
He had been served with the order on November 21 and the residence on Walnut Drive was a protected address, the complaint said.
The complaint said Fernandez also violated the order of protection by texting the woman, who was the petitioner in the order of protection, that he would “kick in the door” prior to the break-in occurring.
Court documents said Fernandez texted the woman threatening her and her home with violence while using abusive language before acting on the threat by kicking down her front door and causing damage to her residence.
According to the order of protection petition filed by the victim, Fernandez had threatened to take their child out of state without her permission. She also said Fernandez had been physically abusive to her in the past and threatened to kill himself and others.
The McHenry County State’s Attorney’s Office filed a petition to detain Fernandez pending trial, arguing he is a threat to the woman and no conditions of release could mitigate the threat.
McHenry County Judge Jeffrey Altman granted the petition and remanded Fernandez to the McHenry County Jail.
The judge said Fernandez’s actions “indicate he cannot be expected to follow any court orders” so no conditions of release can mitigate the “real and present threat he poses” to the victim.
Fernandez is scheduled to appear in court again on January 2 for a preliminary hearing.
