Shawn P. Fontaine, 32, of Marengo.

A man has been sentenced to five years in prison after he failed to comply with his probation he received for intentionally seriously injuring a six-week-old baby in Huntley.

Shawn P. Fontaine, 32, of Marengo, was charged in January 2020 with aggravated battery to a child under the age of 13, a Class X felony.

A bill of indictment said that Fontaine caused great bodily harm or permanent disability to a child after he “violently shook and/or violently struck” the baby.

The Huntley Police Department said they were notified after the six-week-old baby was admitted to Northwestern Medicine Hospital in Huntley with injuries on January 18, 2020.

The infant was later transferred to Lurie Children’s Hospital in Chicago due to the severity of the injuries, then-Huntley Deputy Police Chief Michael Klunk said at the time.

The child was put in protective custody following the incident, Klunk said.

Fontaine entered into a negotiated plea deal with the McHenry County State’s Attorney’s Office in January 2022.

Court records show he pleaded guilty to a reduced charge of aggravated battery causing great bodily harm, a Class 3 felony, in exchange for his Class X felony charge being dismissed.

Then-McHenry County Circuit Judge Michael Coppedge approved the plea deal and sentenced Fontaine to 60 days in the McHenry County Jail.

Fontaine was placed on 30 months of probation and ordered to pay $3,824 in court fines and fees.

Fontaine was also ordered to undergo anger management, psychological treatment and drug/alcohol treatment, along with parenting classes.

In May, prosecutors filed a petition to revoke his probation after accusing him of failing to report to his probation officer on five separate occasions and failing to report for random drug and alcohol screenings on four occasions.

Prosecutors also said he tested positive for alcohol and failed to complete recommended substance abuse treatment.

Fontaine in July admitted to two of the allegations, waived his right to a hearing and the matter was set for sentencing, which was delayed several times.

The sentencing hearing was held on Friday and McHenry County Judge Tiffany Davis sentenced Fontaine to five years in the Illinois Department of Corrections.
