Prosecutors say two street gang members drove around an apartment complex in North Chicago while one of them committed two shootings, including shooting at a person.

Lake County Assistant State’s Attorney Nicholas Shepherd said the North Chicago Police Department responded around 3 p.m. on December 30 to a report of shots fired at the Regency Apartments.

Witnesses reported a car shot at someone and then exited the apartment complex before firing shots again, Shepherd said. No one was believed to be injured.

Officers also received another call for a Ford Fusion whose occupants were flashing guns at another car.

The suspect vehicle was identified as a Ford Fusion and police officers in Waukegan located the car later that night at a gas station, at which time it fled from them, Shepherd said.

Officers recovered surveillance video from the North Chicago apartment complex capturing the shootings.

The car was occupied by the driver and a passenger. Shepherd said the masked passenger was seen shooting out of the car.

The Ford was located the next day by the North Chicago Police Department and a traffic stop was conducted.

The driver, Benjamin V. Gutierrez, 18, of Waukegan, told officers he was driving the car, which belonged to his mother, the day prior, Shepherd said.

The mother gave officers consent to search the car and her home after Gutierrez let officers search his phone and they found photos of him holding a gun.

Shepherd said the search of the home resulted in officers locating a loaded Glock 19 handgun with a laser. Gutierrez is not legally allowed to possess the gun.

Officers also found videos of the passenger in the Ford holding two different guns.

Gutierrez told officers he and the passenger were looking for someone inside the apartment complex after being at a cemetery in Gurnee for the anniversary of a friend’s death, Shepherd said.

Gutierrez said he was armed with one gun and the passenger, a Latin King gang member, was armed with two guns.

Shepherd said Gutierrez is a Latin King gang member and evidence was located on his phone supporting it.

Gutierrez was charged with reckless discharge of a firearm, possession of a firearm by a gang member and two counts of aggravated unlawful possession of a weapon.

Attorney James Schwarzbach, who is representing Gutierrez, said his client did not fire shots and the man does not have a criminal history.

The Lake County State’s Attorney’s Office filed a petition to detain Gutierrez pending trial and Lake County Judge Michael Nerheim granted the petition.

Gutierrez is scheduled to appear in court again on January 23 for a preliminary hearing.
