At least two suspects were arrested on drug charges after a search warrant at a home in Cary led to multiple suspects fleeing, prompting a heavy police response Monday evening.

The McHenry County Sheriff’s Office said around 10:15 p.m. Monday that there was a heavy police presence in the 1300 block of Geneva Lane in Cary.

“Please avoid the area until further notice,” the sheriff’s office said in an alert.

The Cary Police Department also issued an alert saying that there was police activity in the subdivision near New Haven Drive and Collins Drive.

Police were searching for subjects that fled from a residence in the area, the department said. “Please call 911 to report any suspicious persons.”

Cary Deputy Police Chief Scott Naydenoff said the sheriff’s office was executing a search warrant at a residence in the 1300 block of Geneva Lane.

Several occupants of the house fled on foot, Naydenoff said.

Naydenoff said Cary officers were requested to assist in attempting to locate the subjects who fled the residence.

Court records show at least two suspects were arrested — David J. Derita Jr., 42, of Cary, and Kurt M. Niezgoda, 31, of Cary.

Derita was charged with manufacturing or delivery of cocaine, possession of methamphetamine and possession of a controlled substance.

A criminal complaint filed in McHenry County Circuit Court alleges Derita possessed 1-15 grams of a substance containing cocaine with the intent to deliver and also possessed less than five grams of methamphetamine.

The McHenry County State’s Attorney’s Office has filed a petition to detain Derita pending trial, calling him a real and present danger to the community.

Niezgoda was charged with one count of possession of methamphetamine. A criminal complaint alleges he possessed less than five grams of methamphetamine.

Prosecutors are not seeking Niezgoda’s detainment because his charge is non-detainable.

Both suspects reside at the home where the warrant occurred. It is unclear whether other suspects are being sought.

Naydenoff deferred further questions to the McHenry County Sheriff’s Office, which is the lead agency. The sheriff’s office has not released information yet on the case.
