
The sheriff says three were arrested on drug charges after a search warrant at a home in Cary led to multiple suspects, who are still being sought, fleeing and prompting a heavy police response.
The McHenry County Sheriff’s Office said around 10:15 p.m. Monday that there was a heavy police presence in the 1300 block of Geneva Lane in Cary.
“Please avoid the area until further notice,” the sheriff’s office said in an alert.
The Cary Police Department also issued an alert saying that there was police activity in the subdivision near New Haven Drive and Collins Drive.
Police were searching for subjects that fled from a residence in the area, the department said. “Please call 911 to report any suspicious persons.”
Cary Deputy Police Chief Scott Naydenoff said the sheriff’s office was executing a search warrant at a residence in the 1300 block of Geneva Lane.
Several occupants of the house fled on foot, Naydenoff said.
Naydenoff said Cary officers were requested to assist in attempting to locate the subjects who fled the residence.
McHenry County Sheriff’s Office Lt. Porfirio Campos-Cruz said the search warrant was secured after the sheriff’s office received information that narcotics-related crimes were occurring at the residence.
David J. Derita Jr., 42, of Cary; Kurt M. Niezgoda, 31, of Cary; and William B. Roach, 33, of Elgin, were arrested for drug-related offenses, Campos-Cruz said.
Derita was charged with manufacturing or delivery of cocaine, possession of methamphetamine and possession of a controlled substance.
A criminal complaint filed in McHenry County Circuit Court alleges Derita possessed 1-15 grams of a substance containing cocaine with the intent to deliver and also possessed less than five grams of methamphetamine.
The McHenry County State’s Attorney’s Office filed a petition to detain Derita pending trial, calling him a real and present danger to the community.
McHenry County Judge Cynthia Lamb granted the petition after saying his criminal record is extensive and contains almost yearly arrests.
Niezgoda was charged with one count of possession of methamphetamine. A criminal complaint alleges he possessed less than five grams of methamphetamine.
Prosecutors did not seek Niezgoda’s detainment because his charge is non-detainable.
Niezgoda and Derita reside at the home where the warrant occurred, court records show.
Roach was charged with obstructing justice, possession of cocaine, resisting a peace officer, possession of drug paraphernalia and improper possession of cannabis in a vehicle.
Campos-Cruz said Roach was seen leaving the residence just prior to the execution of the warrant.
Police conducted a traffic stop on him and he disregarded their orders, resisted arrest and destroyed evidence, Campos-Cruz said.
A criminal complaint alleges Roach possessed less than 15 grams of a substance containing cocaine and also threw a glass crack pipe on the ground, shattering it, while being arrested.
Prosecutors did not seek Roach’s detainment because his charge is non-detainable.
Campos-Cruz said several individuals fled the area on foot prior to police arrival.
A search of the area was conducted but was unsuccessful and the investigation is ongoing.
