
A bicyclist has filed a lawsuit against the Village of Cary and a police officer after he was left injured when a police squad hit him in Cary in December.
The incident happened around 4:30 p.m. on December 17 at Three Oaks Road and Silver Lake Road in Cary.
Cary Deputy Police Chief Scott Naydenoff said at the time that a collision occurred involving a Cary police squad and a bicycle.
The adult male bicyclist suffered minor injuries and was transported to a local hospital by ambulance.
Naydenoff said the officer involved was uninjured.
The bicyclist was riding southbound on the sidewalk on the east side of Silver Lake Road, Naydenoff said.
The officer was turning northbound onto Silver Lake Road from westbound Three Oaks Road.
A lawsuit filed on Tuesday in McHenry County Circuit Court said the bicyclist was operated by John Dicecco.
Dicecco proceeded northbound through the intersection in the crosswalk while the northbound traffic had a green light, according to a complaint.
The officer, identified as Wesley Leckrone, was stopped for the red light and then proceeded forward into the intersection in his marked squad while attempting to turn right, resulting in the collision, the complaint said.
The lawsuit said that Leckrone had a duty to exercise reasonable care in the operation of the squad car.
Dicecco suffered injuries as a result of Leckrone’s actions, the complaint said, adding that the plaintiff is seeking an unspecified amount in damages from the Village of Cary and Leckrone.
The McHenry County Sheriff’s Office was called to investigate because it involved a Cary police squad, Naydenoff said.
No citations were issued and the officer was not responding to a call at the time of the crash.
The first court hearing in the suit is scheduled for April 29.
