Police say a suspect is in custody after he reportedly attacked an elderly man, who was discovered with serious injuries in a stairwell of an apartment building in Fox Lake.
The Fox Lake Police Department responded around 3:22 a.m. on April 12 to the 300 block of Devlin Road for a report of a battery.
Fox Lake Police Department Sgt. Rick Howell said officers arrived and found a victim at the bottom of a stairwell at the apartment building.
The 62-year-old Fox Lake man was suffering from extensive injuries.
The Fox Lake Fire Protection District was called and arrived at the scene to transport the victim to a nearby hospital for treatment.
Howell said detectives determined that the victim was attacked by Deeyavion M. James, 24, who resides in the 300 block of Devlin Road in Fox Lake, following a verbal argument in a nearby apartment.
James and the victim were gathered with mutual friends at the apartment when the argument led to the physical attack, Howell said.
Investigators located James at his residence on Tuesday and took him into custody.
The Lake County State’s Attorney’s Office reviewed the facts and circumstances of the case and approved charges of aggravated battery to a victim over 60, a Class 3 felony.
Howell said additional charges are possible as the case will be reviewed further.
James remains held at the Fox Lake Police Department and will be transported to First Appearance Court at the Lake County Courthouse in Waukegan on Wednesday morning.
