A Union man who had a warrant issued for his arrest on allegations that he routinely peeped into the windows of McHenry County victims has been arrested.
Dustin D. Hanabarger, 35, of Union, was booked into McHenry County Jail at 7 p.m. on Thursday after being charged in May with one count of enhanced disorderly conduct for window peeping, a Class 4 felony, records show.
A criminal complaint filed in McHenry County Circuit Court in June alleges Hanabarger entered upon the property of another person in the 500 block of Telegraph Street in Marengo around 10:35 p.m. on May 31.
The complaint said Hanabarger entered the property for a “lewd or unlawful purpose” and deliberately looked into the home through a window.
An arrest warrant was issued for Hanabarger on June 23, court records show. He was taken into custody on Thursday.
He appeared in McHenry County court on Friday and was released from jail on electronic home monitoring by McHenry County Judge Cynthia Lamb.
Hanabarger is only allowed to leave his home for work purposes, medical appointments, court appearances, and to purchase food, court records show.
He is also required to check with probation before leaving his home for any purpose, and is required to surrender any firearms or other dangerous weapons in his possession to the Marengo Police Department within 24 hours.
He is also ordered not to go back to the homes of the people he’s been accused of previously peeping at.
The charge against Hanabarger is enhanced because he has been convicted at least twice previously for the same offense.
Hanabarger was charged in 2021 and 2022 with a total of four counts of disorderly conduct by window peeping, a Class 4 felony.
One of the cases alleged that Hanabarger was seen looking through a window of a residence “under the cover of darkness” on September 16, 2022, according to a criminal complaint.
The incident occurred at an apartment building in the 1400 block of Commons Drive in Woodstock.
Hanabarger was arrested by the Woodstock Police Department the next day.
McHenry County Assistant State’s Attorney Ashur Youash said Hanabarger committed the offense while out on bond in three other window peeping cases in Woodstock.
Youash said in court documents that the victim in a February 2022 window peeping case, which occurred on Seminary Avenue, was upset that Hanabarger had been released on bond after he had been arrested.
The woman suffers from anxiety about Hanabarger being “free,” Youash said at the time.
The victim in a June 2022 window peeping case, which occurred on Willow Brooke Drive, felt unsafe after Hanabarger was released from custody following that incident, Youash said.
The fourth window-peeping case against Hanabarger occurred in December 2020 on Leah Lane in Woodstock.
Hanabarger was previously convicted of window peeping offenses in 2011 in McHenry County and in 2020 in Lee County, Youash said.
Hanabarger entered into a negotiated plea deal with the McHenry County State’s Attorney’s Office in August 2023, where he pleaded guilty to two counts of disorderly conduct in exchange for his other two counts being dismissed.
McHenry County Judge Tiffany Davis approved the plea deal and sentenced Hanabarger to three years in the Illinois Department of Corrections on both charges.
It is unclear when exactly Hanabarger was released from the IDOC after being sentenced in 2023.
