A Batavia man who was found guilty at trial of driving with a blood alcohol content that registered more than five times the legal limit has been sentenced to six months in McHenry County jail, court records show.

Tafadzwa Ndlovu, 34, was convicted of a Class 4 felony charge of aggravated driving under the influence of alcohol causing great bodily harm during a bench trial that concluded Friday, court records show.

As a result of the guilty verdict, Ndlovu was sentenced to 180 days in McHenry County jail and two years of felony probation during a sentencing hearing that concluded on Jan 30.

Ndlovu is also sentenced to perform 580 hours of public service upon his release from jail, court records show.

Ndlovu was taken into custody following the sentencing hearing, court records show.

According to the complaint filed in McHenry County court, Ndlovu was driving a 2022 Honda CRV westbound on Charles Road east of Route 47 at 2:30 p.m. on Aug. 18, 2024.

Ndlovu was driving behind a 2006 Toyota RAV4 that was slowing as it approached a four-way stop at the intersection of Charles Road and Route 47.

When the Toyota started slowing down, Ndlovu continued his cruising speed until he rear-ended the Toyota, court records show.

The force of the crash caused the Rav4 to hit an embankment, overturn, and land upright, court records show.

A passenger of the Toyota was flown from the scene of the crash to Condell Medical Center in Libertyville with life-threatening injuries, court records show.

The passenger was later determined to be suffering from a brain bleed and a fractured ankle, court records show.

It was discovered in the hospital’s toxicology report that the defendant had a BAC of .417, court records show.

The legal limit for BAC is .08.

Police also recovered three unsealed bottles of an alcoholic beverage inside Ndlovu’s vehicle, records show.

Ndlovu was found guilty following a three-day bench trial in front of McHenry County Judge Mark Gerhardt.

He was also ordered to pay $4,534 in fines and $200 in restitution to the victim, records show.
