A Johnsburg woman was arrested after she allegedly attacked a witness in a child sexual assault case at the McHenry County Courthouse in Woodstock with the intent to harass her.
Carmen H. Miramontes, 32, of Johnsburg, was charged with harassing a witness, a Class 2 felony, and aggravated battery in a public place, a Class 3 felony.
A criminal complaint filed in McHenry County Circuit Court alleges Miramontes caused bodily harm to a family member around 10:50 a.m. Friday at the McHenry County Government Center, which includes the county courthouse, in Woodstock.
Moramontes grabbed the female by the neck and struck her several times, causing visible injuries, including scratches and redness, the complaint said.
The complaint said Miramontes attacked the victim with the intent to harass or annoy her because the victim is expected to serve as a witness and provide testimony in a pending criminal case.
Court records show that pending case involves Juan Miramontes, 41, of Crystal Lake, who was charged in April with seven counts of predatory criminal sexual assault of a child, a Class X felony, and one count of possession of a weapon by a felon, a Class 2 felony.
A criminal complaint filed in McHenry County Circuit Court alleges Miramontes sexually assaulted a child, who was under 13, on multiple occasions from November 2023 to April 2026.
Prosecutors said that Miramontes sexually assaulted a 9-year-old victim over a period of approximately three years.
The alleged assaults occurred at Miramontes’ residence in the 500 block of Eagle Street in Crystal Lake.
Court documents said Miramontes lives at the home with his wife and multiple children.
Investigators also conducted a search of the residence and recovered a Remington 870 shotgun concealed beneath Miramontes’ bed, prosecutors said.
Miramontes is a convicted felon after previously being convicted of home invasion, a Class X felony.
He was sentenced in 2010 to 12 years in the Illinois Department of Corrections for the offense and is prohibited by law from possessing firearms. He has a total of 12 felony convictions in his criminal history.
Miramontes previously had a FOID card, which is now revoked. The gun was found on the side of the bed he sleeps on, along with a state identification card of his, court documents said.
Court documents said Miramontes used several different measures to obtain compliance from the victim, including physical force and showing her explicit videos to instruct her on what to do.
He also allegedly told the victim he was preparing her “for when she got older,” court documents said.
“These are horrific allegations involving the prolonged abuse of a young child,” McHenry County State’s Attorney Randi Freese said in April when Miramontes was arrested.
“Given the nature of these charges and the defendant’s criminal history, the Court’s decision reflects the serious danger he poses. Our office remains committed to holding offenders accountable and protecting the children and families of McHenry County,” Freese said.
Miramontes, who remains detained in the McHenry County Jail, appeared for a status of trial date hearing and hearing on motion discovery in Courtroom 304 on Friday morning, which is around the time of the incident involving Carmen Miramontes and the witness in the case.
Carmen Miramontes appeared in Initial Appearance Court on Saturday and was released from custody by McHenry County Judge Joel Berg.
She was ordered not to have contact with the victim of the attack or the victim in the sexual assault case. She is also barred from coming to the courthouse when the case involving Juan Miramontes has scheduled court proceedings.
Carmen Miramontes is scheduled to appear in court again on June 30 for a status of preliminary hearing.
